Welcome to Magic Years. These Terms of Use (“Terms”) govern your access to and use of the Magic Years website, newsletters, content, and related services (collectively, the “Services”). Magic Years is published by Good City, LLC (“Magic Years,” “we,” “us,” or “our”). By accessing or using the Services, subscribing to a Magic Years newsletter, submitting material to us, or otherwise using the Services, you agree to these Terms. If you do not agree to them, please do not use the Services.

About Magic Years

Magic Years is a free newsletter and website for parents and caregivers, primarily focused on the years from birth through about age 10.

Our content may include parenting ideas and information, local events and activities, recommendations, community information, products and services, advertisements, sponsored content, affiliate links, and other material we think may be useful to parents and caregivers.

Some content is selected, written, or edited by Magic Years. Some information originates with businesses, event organizers, public sources, readers, experts, publishers, or other third parties. Some content or placements may be paid.

Eligibility

The Services are intended for adults and are not directed to children.

You must be at least 18 years old to subscribe to the Services, submit material on behalf of a business, purchase advertising, or otherwise enter into an agreement with Magic Years.

Our collection and use of Personal Information, including information relating to children, is described in our Privacy Policy.

Newsletter Subscriptions

Magic Years newsletters are currently provided free of charge.

When you subscribe, you agree to receive the newsletters and related communications associated with your subscription. You may unsubscribe using the unsubscribe link included in our emails or by using other preference options we make available.

We may change the timing, frequency, format, name, geographic availability, or content of a newsletter. We may also add, combine, suspend, or discontinue newsletters or other parts of the Services at any time.

We do not guarantee that any particular newsletter or communication will be delivered at a particular time or without interruption.

Informational Purposes Only

Magic Years provides general educational and informational content.

Our content is not individualized advice, and it is not intended to diagnose, treat, prevent, or address any medical, psychological, developmental, legal, financial, safety, or other professional issue.

Nothing in the Services creates a doctor-patient, therapist-client, attorney-client, or other professional relationship between you and Magic Years or any person whose work or guidance may be referenced in our content.

Parenting approaches, activities, products, routines, and recommendations are not appropriate for every child or family. You are responsible for deciding whether information or activities are appropriate for your circumstances and for seeking qualified professional advice when appropriate.

If you have questions about a child’s health, development, safety, feeding, sleep, mental health, or other individual needs, consult an appropriate qualified professional.

The Services are not an emergency service. Do not rely on Magic Years for emergency alerts, severe-weather warnings, evacuation notices, medical emergencies, or other urgent safety information. Use official emergency services and authoritative local sources.

Accuracy and Local Information

We work to provide useful and timely information, but we do not guarantee that all information in the Services is complete, current, accurate, or error-free.

Local information can change quickly. Events may be canceled, postponed, moved, or sold out. Businesses and organizations may change their hours, prices, policies, locations, schedules, age requirements, accessibility, registration deadlines, or availability without notice.

Before making plans, purchases, registrations, travel decisions, or other decisions based on information in Magic Years, you should confirm important details directly with the relevant organizer, venue, business, service provider, or other primary source.

If you believe something published by Magic Years contains a factual error, you can contact us at hello@magicyears.com. We retain editorial discretion over whether and how material is corrected, clarified, updated, or removed.

Recommendations and Third Parties

Magic Years may mention, recommend, link to, or feature products, businesses, events, venues, organizations, services, websites, or other third parties.

Unless we expressly state otherwise, Magic Years does not own, operate, control, or act as an agent for those third parties. We are not responsible for their products, services, content, pricing, availability, reservations, refunds, policies, conduct, accessibility, security, or safety practices.

A recommendation, selection, inclusion, editorial description, or “favorite” reflects editorial judgment or the information available to us at the time. It is not a guarantee that you will have the same experience, that a product or service will meet your expectations, or that an activity is appropriate or safe for a particular child or family.

If you leave Magic Years through a third-party link, your use of that third party’s website, service, or product is governed by its own terms, privacy practices, and policies.

Advertising, Sponsorships and Affiliate Links

Magic Years may be supported by advertising, sponsorships, affiliate relationships, and other commercial arrangements.

When required or appropriate, we identify commercial relationships through labels, disclosures, asterisks, or other disclosure methods designed to make the relationship clear.

Paid arrangements may affect whether, where, or how prominently certain commercial material appears.

Magic Years may also earn a commission or other compensation when you click certain links, make a purchase, book a service, or take another qualifying action.

Unless expressly stated otherwise, Magic Years is not the seller or provider of third-party products or services promoted or linked through the Services. Any purchase, booking, subscription, return, refund, warranty, or other transaction is between you and the applicable third party and is subject to that third party’s terms and policies.

Editorial Decisions

Except where we have expressly agreed otherwise in writing, Magic Years retains editorial discretion over the Services.

This includes decisions about what to cover, recommend, feature, edit, characterize, update, correct, decline, or remove.

Submitting an event, business, product, recommendation, tip, story, photograph, or other material does not guarantee publication, coverage, or endorsement.

Editorial coverage does not create a commercial relationship, and we are not required to pay for unsolicited editorial submissions unless we have agreed otherwise in writing.

Material You Submit

If you submit content or other material to Magic Years, including an event listing, recommendation, photograph, comment, suggestion, correction, feedback, or business information (“Submitted Material”), you represent that:

the information you provide is accurate to the best of your knowledge;
you have the rights and permissions necessary to provide it to us;
our permitted use of it will not infringe another person’s intellectual property, privacy, publicity, contractual, or other rights; and
the material is not fraudulent, misleading, unlawful, defamatory, or otherwise prohibited by these Terms.

You retain ownership of Submitted Material that you own.

By submitting it to Magic Years, you grant Good City, LLC a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, reproduce, edit, adapt, publish, display, distribute, and otherwise use that Submitted Material in connection with Magic Years, the Services, and promotion of Magic Years.

This license allows us, for example, to shorten an event description, crop or format submitted imagery, include submitted information in a newsletter, or promote content that appeared in Magic Years.

You are not entitled to compensation for our use of Submitted Material unless we have separately agreed otherwise in writing.

Intellectual Property

The Services and the original material made available through them, including Magic Years text, newsletters, editorial compilations, designs, graphics, branding, logos, and other content, are owned by or licensed to Good City, LLC and are protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

You may share links to publicly available Magic Years content and may quote limited portions where permitted by law.

Unless we give you written permission or applicable law permits it, you may not:

reproduce, republish, distribute, sell, license, or commercially exploit substantial portions of the Services;
systematically scrape, crawl, download, extract, or copy content from the Services;
use the Services or substantial portions of our content to build or populate a competing publication, database, directory, product, or service;
remove copyright, trademark, or other proprietary notices;
use Magic Years trademarks, branding, or logos in a way that suggests endorsement, affiliation, or sponsorship without permission; or
attempt to circumvent technical measures designed to protect the Services.

Nothing in these Terms transfers ownership of Magic Years intellectual property to you.

Prohibited Conduct

You may not use the Services to:

violate applicable law;
impersonate another person or misrepresent your identity or affiliation;
submit materially false, fraudulent, or misleading information;
infringe intellectual property, privacy, publicity, or other rights;
distribute malware, malicious code, spam, or unauthorized solicitations;
interfere with or attempt to gain unauthorized access to the Services or systems used to provide them;
harvest Personal Information about other users;
use automated systems to access or extract content in violation of these Terms; or
use the Services to facilitate unlawful activity.

We may restrict or terminate access to the Services when we reasonably believe these Terms have been violated or when necessary to protect Magic Years, our readers, our systems, or third parties.

Intellectual Property Complaints

If you believe material available through Magic Years infringes your copyright or other intellectual property rights, contact us at hello@magicyears.com.

Please include enough information for us to identify the work or right at issue, locate the material you are concerned about, understand the basis of your claim, and contact you regarding the request.

We may request additional information before acting on a complaint.

Privacy

Our collection, use, and disclosure of Personal Information is governed by our Privacy Policy.

Please review that policy for information about our privacy practices, including newsletters, analytics, advertising measurement, and information relating to children.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services and all content made available through them are provided “as is” and “as available.”

Good City, LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services or content will be accurate, complete, reliable, current, secure, available, error-free, or uninterrupted; that defects will be corrected; or that the Services will meet your particular needs or expectations.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by applicable law, Good City, LLC and its affiliates, members, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of, or inability to access or use, the Services.

This includes damages arising from reliance on content; participation in an activity or event; dealings with a third-party business, product, or service; or content, products, or services accessed through third-party links.

To the maximum extent permitted by law, the total aggregate liability of Good City, LLC for claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid directly to Good City, LLC for the Services giving rise to the claim during the 12 months before the claim arose or (b) $100.

The limitations in this section apply only to the extent permitted by applicable law.

Indemnification

If you submit material on behalf of a business or other organization, purchase advertising or sponsorship services, or otherwise use the Services for commercial purposes, you agree, to the extent permitted by law, to defend, indemnify, and hold harmless Good City, LLC and its affiliates, members, officers, directors, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable costs and expenses arising from:

material you submit;
your commercial use of the Services;
your violation of these Terms; or
your infringement or violation of another person’s rights.

Any separate advertising, sponsorship, insertion order, or other commercial agreement between you and Magic Years may contain additional terms. If those terms conflict with these Terms regarding that commercial relationship, the more specific written agreement will control.

Changes to the Services and These Terms

We may modify, suspend, or discontinue all or part of the Services at any time.

We may also update these Terms from time to time. When we do, we will revise the “Last updated” date above.

Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Services will be governed by the laws of the State of Washington, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any legal action or proceeding arising out of or relating to these Terms or the Services that is brought in court will be brought in the state or federal courts located in King County, Washington, and you and Good City, LLC consent to the jurisdiction of those courts.

Miscellaneous

These Terms, together with our Privacy Policy and any other terms expressly incorporated into them, constitute the entire agreement between you and Magic Years regarding your use of the Services.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other right.

You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or other transfer of our business.

Provisions that by their nature should survive termination of these Terms will survive, including provisions concerning intellectual property, Submitted Material, disclaimers, limitation of liability, indemnification, and governing law.
